TERMS AND CONDITIONS OF ENTRY – BRITISH PAINTS ‘BEST OF BRITISH’ PROMOTION
1. Information on how to enter and prizes forms part of these terms and conditions of entry.
2. Submission of an entry and / or acceptance of a prize is deemed to be acceptance of these terms and conditions of entry. If you do not agree to these terms and conditions you should not enter the competition or accept a prize.
3. This promotion is open to New Zealand residents only. Anyone employed by (or an immediate family member of someone employed by) the Promoter, Mitre 10, or the Promoter’s associated companies or advertising agencies, is ineligible to enter or win.
4. You may enter by sending a text message from any text-capable NZ mobile phone containing the unique promotional code (found under the scratch panel on the promotional card. One card can be collected at Mitre 10checkout, with every purchase of any 4L and 10L British Paints products) to 321. You will be responsible for the cost of the text charged by your service provider. Text messaging will be charged at your normal rate for text messaging. An entry via text is deemed to be from the individual who is the registered user of the mobile phone from which the entry was sent. Winners may be required to provide proof of identity (e.g. driver’s licence or passport, and evidence that he or she is the registered user of the relevant mobile phone).
5. All valid entries received by text will be entered into the main prize draw for the trip for two to Britain (see clause 7 below for dates).
6. Main Prize – 1 main prize consisting of ‘a trip for two to Britain.’ This will be awarded in the form of travel vouchers to the value of (New Zealand) $12,000 and a $4,000 cheque for spending money and accommodation
7. The Promoter reserves the right to substitute a prize for a prize of equal or greater value if a prize is unavailable.
a. Entries for the main draw must be received by midnight on 05/04/10 (‘Closing’). Entries received after Closing will not be valid. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
b. The main prize will be randomly drawn on 07/04/10 from all valid entries received during the promotion. The winner will be advised by phone. The winner must respond within two weeks of the notification or forfeit the prize and another winner will be drawn.
c. If the main prize-winner is under the age of eighteen, the prize will be awarded to the winner’s parent or guardian.
8. The Promoter shall not be liable for any injury or loss or damage whatsoever (including but not limited to any indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize or participation in the promotion except for any liability which cannot be excluded by law.
9. By accepting a prize, the winner agrees that the Promoter may use his/her name, address and photograph for publicity purposes including but not restricted to on packaging, or in public relations and marketing material via the internet or otherwise.
10. All prizes stated are not transferable and not redeemable for cash.
11. Entrants must keep their proof of purchase (till receipt and scratch card panel). Prize-winners will be asked to present proof of purchase on redemption of prizes.
12. Winners will be notified by telephone no later than 5 days after the draw. The Promoter's decision is final and no correspondence will be entered into.
13. You may enter by text message as many times as you like, provided you use a different code obtained from a scratch card obtained through the purchase of eligible products from Mitre 10. Each unique code may only be used once, and may only be entered into the competition by text message.
14. Late, lost, incomplete, incomprehensible, illegible or damaged entries or proof of purchase will be deemed invalid and the Promoter accepts no responsibility for such entries/ proof of purchase documents.
15. The Promoter has no control over internet or mobile telephone communications, networks or lines, bugs, viruses and server problems and accepts no responsibility for any problems associated with them, for whatever reason.
16. All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion, announce the winner and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1993 and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available on request). An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter . Entrants may also (subject to the Finalist’s Agreement) request that the Promoter cease to use their personal information for publicity or advertising purposes by calling 0800 800 424.
17. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the prizes and these Conditions of Entry. The Promoter may cancel or postpone the Promotion or the Series at any time at its sole discretion.
18. The Promoter is British Paints New Zealand, a business division of DuluxGroup (New Zealand) Pty Ltd, of 150 Hutt Park Road, Lower Hutt.
19. Scratch and Win Prizes
There will be 1 prize awarded for every Scratch and Win card distributed (10,000 cards in total).
a. Prize pool consists of 12 Black & Decker Hedge Trimmers,8 Cobra Water blasters, 15 Black & Decker 12V Cordless Drills, 400 Accent project 50mm brushes, 415 Accent Roller sleeve smooth 230mm, 7980 Tape measure key rings, 500 London Bus models, 670 Mini Cooper models.
b. Prizes can be redeemed with a valid Scratch Card and itemised receipt showing a British Paints purchase only in the store of purchase. Prizes must be redeemed by the close of the promotion on 05/04/09.
c. Prizes can be claimed by exchanging the scratch and win portion of the promotional card for the prize shown under the panel at Mitre 10 customer service counters.
